These general conditions of sale apply between the company SPARTAN, SAS, 30 rue Lacépède 75005 Paris, RCS Paris 818 869 489 (hereinafter “SPARTAN”) and any individual consumer making a purchase on the website www.spartan-underwear.com (hereinafter “the customer”).
These general conditions of sale govern apply to all purchases made on the website www.spartan-underwear.com (hereinafter “the website”).
Any order placed on the website entails the unconditional acceptance by the customer of these terms of sale. These conditions can be modified at any time without notice by SPARTAN, the applicable conditions are those in effect on the date of the order by the customer.
The products presented on the website are accompanied by a description and images that do not have contractual value. SPARTAN does not incur any liability for error or omission on these descriptions.
SPARTAN doesn’t claim to diagnose, prevent or treat any disease or other health problems.
The prices listed on the website are indicated all French taxes included, excluding shipping costs. Prices may be changed at any time without notice by SPARTAN. The products will be billed based on rates in effect at the time of registration of the order.
Delivery charges will be indicated to the customer in the basket before final confirmation of the order.
All orders will be confirmed after acceptance of payment.
SPARTAN reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning the payment of a previous order.
Orders are accepted within the limits of available stocks. The availability of the products is indicated in the product description and prior to the validation of the basket.
Customers can pay their order by credit card (Visa, Mastercard, American Express).
Full payment must be made when placing an order.
The payment solution used by SPARTAN is 100% secure. The secure platform proposed on the online store is STRIPE. STRIPE platform complies with regulations concerning credit cards distance payments and online payments.
The products are delivered to the address provided by the customer when ordering. The customer must ensure that he have provided accurate and complete information concerning the delivery address.
SPARTAN delivers its products within France and worldwide. Shipping fees vary according to the country and are listed on the website.
The delivery times indicated on the website are informative. SPARTAN cannot be held responsible for consequences due to delayed delivery.
Upon receiving the order, the customer must check the conformity of products. In case of any anomaly concerning the product or the delivery (damaged or missing), the customer must notify SPARTAN within 24 hours from receipt. After this period, SPARTAN disclaims any responsibility.
7- Customs Duties
Any order placed on the website and delivered outside France may be subject to taxes and customs duties. These possible taxes related to the delivery in other countries are the customer responsibility. SPARTAN is not required to check and inform customers of customs duties and taxes outside France. The customer has to check with the relevant authorities in his country.
8. Exchanges and returns
Within fourteen (14) days from receipt of the order, the customer may request SPARTAN to return or exchange the product(s).
The product must be returned in its original packaging, in its original condition, new, unworn and unwashed. The return costs are to be borne by the customer.
The returned product will be exchanged or refund within a maximum of thirty (30) days from its receipt by SPARTAN.
9. Guarantees and Responsibilities
SPARTAN has, for all stages of access to the website, the ordering process, delivery or subsequent services, an obligation of means. The responsibility of SPARTAN cannot be engaged for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion or presence of computer viruses or any other incident of force majeure, according to law and jurisprudence.
The products sold by SPARTAN are in accordance with French legislation. The responsibility of SPARTAN cannot be engaged for non-compliance with the legislation of the country where the product is delivered. It is the customer duty to check with local authorities the possibility of importing or using the products sold by SPARTAN.
In no case SPARTAN can be held responsible for any direct or indirect damages related to the use of purchased products.
SPARTAN cannot be held responsible for medical inefficiency of purchased products.
10. Personal data
SPARTAN reserves the right to collect personal information and customer personal data required for the management of his order. SPARTAN agrees to use such personal data only for the operation of its website. They can also be transmitted to service providers responsible for the delivery.
According to the law of 6 January 1978 amended by the Act of 6 August 2004, the Customer has a right to access and correct personal data in the files of SPARTAN. 11. Intellectual Property
The customer agrees not to copy or download any part of the website content without the express permission of SPARTAN. All copyrights, trademarks and other distinctive signs and property rights or intellectual property appearing on the website, will remain the full property of SPARTAN.
12. Force Majeure
In the event of a force majeure event, the party concerned shall notify the other within fifteen (15) days from the occurrence of the event by registered letter with acknowledgment of receipt.
Explicitly, are considered as force majeure or unforeseeable circumstances beyond those usually retained by the course of jurisprudence and French courts, total or partial strikes, lockouts, riots, boycotts or other actions in industrial or disputes commercial, civil disturbance, insurrection, war, bad weather, epidemics, blockage of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal changes or regulatory forms of marketing, computer failure, telecommunications blocking, including wired and wireless telecommunications networks, and other cases independent of the will of the parties preventing normal execution of the contractual relationship.
All obligations of the parties shall be suspended for the duration of the force majeure event, without compensation.
If the force majeure event continues for more than three (3) months, the contract concerned shall be terminated automatically without indemnity to one or other of the parties.
13. Non partial validity of a clause
If any provision of these present conditions is declared invalid or unenforceable by a competent court, it will be declared unwritten and will not result in the nullity of other stipulations.
These general conditions can be modified at any time without notice by SPARTAN, the applicable conditions are those in effect on the date of the order by the customer.
15. Applicable law – Jurisdiction
These general conditions are subject to French law concerning the substantive rules as the rules of form. Any dispute will be subject to a preliminary attempt at an amicable settlement.
In the absence of an amicable settlement, jurisdiction is given to the competent French courts.
